He was a wanted man with two warrants out for his arrest. But sheriff deputies couldn't find him.
Nineteen-year-old Marquis Marshall was scheduled to appear in court for a previous crime, stealing 2 12-packs of beer from Walmart.
"We had a deputy that had gone out on a couple of occasions to look for Marshall on that theft warrant from the summer," says Major Michael Oliver with the Sedgwick County Sheriff's Office.
Marshall became a fugitive until police arrested him for another crime---killing two people at the Dollar General store on 13th and Oliver.
Major Oliver says that Marshall's warrant for theft, wasn't a high priority.
"If you have 3 or more warrants for the same person, that's probably going to move you up our list of somebody that we're gonna be looking for. Obviously somebody that has a serious person warrant, somebody that's wanted for a homicide or a rape, we're gonna focus more of our attention to finding that person than we would for a person with a theft," says Oliver.
The sheriff's office tells us that there are more than 12,000 warrants out for people's arrest. There are 5 deputies assigned to look for those who've been charged with a felony.
"This is kind of unusual. You're going from a felony theft warrant because of previous theft convictions, now you have a felony theft warrant, clear to the other end of the spectrum, a double homicide to be filed as a capital case," says Oliver.
Short of hiring more deputies to find defendants who aren't showing up to court, Oliver says there won't be many changes, even in light of Marshall's more serious crimes.
"Marshall's warrant was in the works, it was on file...we have to have very good information to track somebody down or somebody to give us a call or Crimestoppers, some information on where to find these folks. We just hadn't gotten that information before he committed the other crimes," says Oliver.
Marshall is scheduled to appear in court on December 18, 2012.
Funeral services are coming up for the two people Marshall killed. 79-year-old Henry Harvey's funeral will be Saturday, December 8.
Zachary Hunt will have a private burial in Blue Springs, Missouri.
