Driver who hit Derby grad had BAC three-times legal limit

The driver who caused a crash that took a Derby High School graduate's legs had a blood alcohol level three times the legal limit.

Colby Liston was getting into the back of a stopped SUV in Lawrence this summer when another vehicle struck him from behind. Liston was pinned between the two vehicles. The impact crushed his legs.

On Thursday, police told the Lawrence Journal-World, the driver that hit liston had a BAC of 2.5. The legal limit is 0.8.

The Douglas County attorney's office will determine if the driver faces charges.
