Rape allegation investigated at Sedgwick County jail

An inmate at the Sedgwick County jail says a deputy handcuffed and raped him in his cell earlier this month.

Two Wichita lawyers are now investigating the claim from June 3rd.

“What is going on is an absolute abuse of authority,” says attorney Mark Schoenhofer.

Schoenhofer says he and Kurt Kerns plan to file a "notice of claim.” That's the first step needed before a civil lawsuit can be filed.

Schoenhofer says it's unclear whether criminal charges will be filed, but he thinks there is enough evidence to prove the abuse happened.

“He was cuffed up, thrown down into the bunk face first and told not to move or he would be tazed.”

Schoenhofer says the abuse happened in the early morning hours of June 3rd in the inmate’s cell. He says the deputy then raped and sodomized the inmate. It wasn’t until after the rape that the inmate discovered there was no stun gun and began yelling for help.

“The allegations are perhaps the most egregious abuse of trust and authority I’ve come across.”

He was taken to Via Christi where a sexual assault exam was performed. Schoehofer says his office has not received the results.

Eyewitness News asked the sheriff about the allegations. He says it's under investigation and the deputy in question does not have contact with inmates.
