A Wichita man involved in a high-speed police chase that resulted in a fatal crash waived his right to a jury trial on Monday.

Police said Javier Rizo, 23, was one of four people in a gray van that fled from a traffic stop in downtown Wichita on October 27, 2013.

Police called off the chase as speeds reached 70 miles per hour. But the van kept going and ran a stop sign at 24th and Broadway. The van struck Maria Martinez's car. She was taken to the hospital where she died from her injuries.

A court spokesman said both sides presented written facts of the case to Judge Dave Dahl, after both attorneys gave short opening statements.

Judge Dahl says he will read the facts, hear closing arguments from the attorneys on Thursday morning at 9:30 and then make his ruling at 3 p.m.  

Rizo is charged with second degree murder, three counts of aggravated battery, fleeing or attempting to elude an officer and a misdemeanor count of battery.
