Suspect in Simmons killing appears in court; Ballentine testifies

TOPEKA, Kan. (WIBW) -- The man accused of killing former Washburn player Dwane Simmons is set to appear in court Monday for his first preliminary hearing.

In the hearing, prosecutors will present their findings so the judge can determine if there is enough evidence for Francisco Mendez to stand trial.

Mendez is charged with first-degree murder, attempted first-degree murder, and five counts of aggravated robbery. He is accused of shooting Dwane Simmons and Corey Ballentine outside a home near SW 13th and Lane in April.

Simmons died at the scene, Ballentine, who was drafted by the New York Giants hours before the incident, has since recovered and joined the team.

The hearing is expected to last all day.
